Terms and Conditions of Service for the Creative Studio: Graphic Designer / Illustrator
These terms are governed by French law and apply to all quotes accepted by the CLIENT (individual or legal entity), as well as all graphic design service orders placed with Margot Papin (hereinafter referred to as the “SERVICE PROVIDER”), through any means made available to the CLIENT (email, telephone, post, contact form). The term CLIENT refers to any individual, business, company or association placing an order with the SERVICE PROVIDER.
The service
I work as an independent graphic designer for businesses, creating graphic design materials, logos, brand guidelines, web design and all types of digital or printed materials. The service includes only what is explicitly listed in the accepted quote. Any request not mentioned in the quote will be considered an additional service and billed separately or subject to a new quote.
The CLIENT acknowledges having reviewed my artistic and technical skills through my portfolio before requesting my services.
General obligations.
The CLIENT agrees to:

Provide a complete, accurate and usable brief before work begins (specifications, text, photos and logos in high-resolution, usable formats);

Ensure that they hold all rights to the materials provided (text, images, logos);

Approve the work or provide feedback within the agreed deadlines.
Three rounds of revisions are included per service. Any additional revisions will be charged separately. Any change to the brief during the project will constitute a new service and be billed separately. I
Terms and Conditions of Sale - Margot's Curiosities Shop: Artistic Creations
These Terms and Conditions apply exclusively to the online sale of artistic creations and items offered through my SumUp Store, accessible at margot-papin.sumupstore.com. These Terms and Conditions are binding on the customer, who acknowledges having read and understood them. Order confirmation constitutes acceptance of the Terms and Conditions in effect on the date of the order.
Product description
My shop offers original artistic creations: illustrations, paintings, art objects, and personalized pieces. Each product has a description outlining its essential characteristics. The photographs illustrating the products are not contractual documents: due to their handcrafted nature, each item may exhibit slight variations.
Orders
All orders placed on the shop are firm and final, subject to the right of withdrawal provided by law where applicable.
I reserve the right to refuse any order for any legitimate reason, including but not limited to non-compliance with these Terms and Conditions, outstanding payments on a previous order, or an ongoing dispute. An order confirmation and a digital invoice will be sent to you by email. I advise you to save these documents on a reliable and durable medium.
Payment methods and security
Payment is made via SumUp (credit card), which ensures the encryption and security of your bank details: I never have access to your full bank details. Payment by bank transfer is possible upon prior request by email: only the information strictly necessary for accounting purposes is then retained. All orders placed on the website are binding and require payment. The order is only considered effective once the payment provider has validated the transaction.
Price
The price of the products in effect at the time of the order is indicated in euros, excluding delivery charges where applicable. Full payment is due upon confirmation of the order.
Delivery (store)

International: Prior quote required; no shipment without written agreement and full payment; fees, customs duties, and regulatory obligations of the destination country are the sole responsibility of the customer.
The delivery times indicated are estimates. I cannot be held responsible for delays caused by the carrier or by force majeure. Products are delivered to the address provided when ordering; it is your responsibility to verify its accuracy. No deliveries are made to P.O. boxes.
RETURNS AND CLAIMS POLICY
The legal framework for the right of withdrawal (time limits, exclusions) is detailed in the "Right of Withdrawal" section. Below you will find the practical conditions for a return.
Conditions for a return (standard products)
To be accepted, the returned product must be in perfect condition, unused, in its original packaging, accompanied by proof of purchase and a letter specifying your contact information and order number. Return shipping costs are your responsibility. Refunds will be processed within 14 days of receipt of the returned product and the necessary information to process the refund.
Claim deadline after receipt: 24 hours
Any claim concerning a delivered product (apparent defect, order error, damage related to transport) must be reported within 24 hours of receipt, by email to contact@margotpapin.com , with supporting photos. After this period, no claims, returns, or refunds will be accepted; the merchandise will be considered received in good condition and conforming to the order.
In the event of a dispute with the carrier, it is your responsibility to make your reservations directly to him at the time of delivery; I cannot be held responsible for damages that occurred during transport.
RIGHT OF WITHDRAWAL — SHOP
In accordance with Articles L.221-18 et seq. of the Consumer Code, you may exercise your right of withdrawal within 14 days from receipt, on standard products only, by means of an unambiguous statement sent to contact@margotpapin.com .
This right is reserved for natural persons acting for purposes which are outside the scope of their professional activity.
Products made to measure or personalized according to your requests cannot benefit from the right of withdrawal, in accordance with article L.221-28 of the Consumer Code.
By confirming your order, you acknowledge that you have been informed of the cancellation terms.
RIGHT OF WITHDRAWAL — SERVICES
In accordance with Articles L.221-18 et seq. of the Consumer Code, the CLIENT acting as a consumer has a period of 14 days from the acceptance of the quote to exercise his right of withdrawal, without having to justify his decision.
This right is reserved for natural persons acting for purposes outside their trade, business, craft, profession, or agricultural activity. Professional clients do not benefit from this right.
When the CLIENT expressly requests the commencement of the performance of the service before the expiry of the withdrawal period, he acknowledges that I may invoice for the services actually performed up to the date of withdrawal.
In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal can no longer be exercised when the service has been fully performed before the end of the legal period, with the prior express agreement of the CLIENT and express waiver of their right of withdrawal.

INTELLECTUAL PROPERTY
Artworks (shop)
The artworks sold through this shop remain my exclusive property until full payment is received, and no transfer of exploitation rights is included in the sale price, even in the case of personalization. The following are prohibited without my prior written authorization: reproduction, distribution, adaptation, use by AI, tattooing, sublicensing, or resale of my creations. The author's moral rights (right of disclosure, right to respect for the work, right of withdrawal), in accordance with Articles L.121-1 to L.121-9 of the French Intellectual Property Code, are inalienable and cannot be waived.
Professional graphic design services
The files delivered as part of a graphic design service do not, in themselves, automatically grant the CLIENT any intellectual property rights. Exploitation rights are granted only through a separately signed and paid license or assignment agreement. Any use of the creations outside the contractual framework constitutes infringement and may be prosecuted in accordance with Article L.335-3 of the French Intellectual Property Code.
Right to publicity
Unless you object in writing and I accept your objection, I reserve the right to present my work on my website, portfolio and social media, and to affix my signature or the mention "Design by Margot Papin" to any digital or commercial medium.
Site ownership
I am the sole owner of all elements present on this website (texts, images, logos, visual identity, structure). None of these elements may be reproduced, distributed, or used without my prior written authorization.
PERSONAL DATA
Data Controller
I am Margot Papin, sole proprietor (SIRET 912 978 574 00024), responsible for the processing of personal data collected via my website and online store.
Data collected
Order-related data: first and last name, billing address, shipping address, email address, phone number, payment information (processed directly by SumUp or via bank transfer, depending on the chosen method). Bank details are never stored by me when payment is made through SumUp. Browsing data: IP address, browser type, time zone, cookies, pages viewed, products viewed, and referral source.
Technologies used
Cookies, log files and web beacons/pixels are used to ensure the operation of the site and to analyze its traffic.
Purposes of processing. Your data is processed to: process and fulfill your orders, manage invoicing, payments and delivery, communicate with you about your order or project, detect fraud, improve the website, and comply with my legal and accounting obligations. In the event of force majeure lasting more than 30 days, either party may terminate this agreement without compensation, except for the deposit already paid.
Applicable law: These Terms and Conditions are governed by, interpreted and applied in accordance with French law. Jurisdiction: French courts.
I reserve the right to modify the website content, its services, and these Terms and Conditions at any time and without prior notice. The applicable version is the one in effect on the date of the order. Continuing the business relationship after modification constitutes acceptance of the new version.
